  • “Client” refers to any person or entity booking or using our services.
  • “Content” includes photos, videos, audio, graphics, text, and any materials created or displayed on our website.
  • “Website” refers to all content, pages, and functionality under Wuliamba Production’s online domain(s).
  1. Use of the Website

You agree to use our website only for lawful purposes. You must not:

  • Attempt to access restricted areas or servers
  • Upload harmful or malicious files

  • Interfere with the website’s security features

We reserve the right to limit or terminate access to the website for users who violate these Terms.

  1. Booking and Payments

3.1 Booking Confirmation

A booking is confirmed only when:

  • The client submits a request
  • Wuliamba Production accepts the request
  • Any required deposit or retainer is paid

3.2 Deposits

Deposits or retainers (if required) are:

  • Non-refundable
  • Applied toward the total cost of the service

3.3 Payment Terms

Full payment must be made by the agreed-upon date.
We reserve the right to withhold delivery of final media until payment is complete.

3.4 Cancellations

Client cancellations may incur fees based on:

  • Time before the scheduled event/project
  • Work already completed
  • Expenses incurred by Wuliamba Production

Cancellation terms will be provided in the service contract/invoice.

  1. Intellectual Property Rights

4.1 Ownership of Creative Work

Wuliamba Production retains the copyright to all photos and videos created unless otherwise stated in writing.

Clients receive a license to use the delivered media for personal or agreed-upon commercial purposes.

4.2 Portfolio Use

With client consent (via contract or release form), Wuliamba Production may use photos or videos for:

  • Portfolio
  • Website
  • Social media
  • Advertising
  • Promotional materials

4.3 Copyright Violations

Clients may not:

  • Edit or alter media without approval
  • Resell delivered content
  • Remove watermarks (if applicable)
  • Claim the work as their own

Unauthorized use may result in legal action.

  1. Client Responsibilities

Clients agree to:

  • Provide accurate information during booking
  • Obtain required permissions for locations, venues, or participants
  • Ensure safe working conditions for the photographer/videographer
  • Respect project timelines and communication requirements

Wuliamba Production is not responsible for delays or issues caused by client nondisclosure or lack of cooperation.

  1. Delivery of Media

6.1 Delivery Method

Final photos and videos are delivered via:

  • Online gallery
  • Download link
  • USB or physical storage (if arranged)

6.2 Delivery Timeline

Estimated delivery times will be provided during booking. Actual delivery may vary depending on:

  • Event complexity
  • Editing requirements
  • Seasonal workload

6.3 Storage of Files

We store client files for a limited period (typically 6–12 months unless otherwise stated).
Clients are responsible for backing up delivered media.

  1. Liability Disclaimer

7.1 Service Availability

We strive for uninterrupted website access, but we do not guarantee:

  • Constant availability
  • Error-free performance
  • Freedom from cyber threats

7.2 Limitation of Liability

Wuliamba Production is not liable for:

  • Loss of data due to client error
  • Delays caused by unforeseen events (weather, illness, equipment failure)
  • Indirect, incidental, or consequential damages

Our maximum liability shall not exceed the amount paid for the service.

  1. Rescheduling & Force Majeure

We may reschedule or cancel services due to circumstances beyond our control, including:

  • Severe weather
  • Illness or injury
  • Equipment malfunction
  • Emergencies
  • Natural disasters

In such cases, we will make reasonable efforts to reschedule or issue a refund where appropriate.
